Organization/Employer Immigration Requirements

Investors and entrepreneurs seek entry into the United States for long and short-term business matters. Similarly, businesses and organizations often benefit from bringing workers or volunteers from overseas to help them work on achieving their businesses’ goals. If you ARE an organization seeking U.S. entry or an employer trying to bring a certain type of expert or worker, who are critical to achieving success in your endeavors, then you may ace unique challenges in the immigration process, requirements and limitations. Whether needing long-term or short-term stay is needed, the process for receiving entry is complicated. The process involves a tremendous time commitment and intricate paperwork. Without experience or familiarity with the process, it is easy to make errors in applications which could lead to additional fees or denial of your visa request. A knowledgeable legal team can be invaluable to help you through the process. Our investor immigration lawyers will walk you through every step of the process. We can discuss with you the type of immigration solution you are seeking, the requirements and limitations, and we can help determine the best course of action for getting the immigration results you need.

Investing in the U.S.

Investors, entrepreneurs and businesses that are willing to invest in the U.S. economy and create American employment have an opportunity to immigrate to the United States. The United States is interested in those who are willing to invest.

Investor Immigration Law Services

At Malik & Associates, PLLC, we provide investor immigration services, including the following:

  • E-1 Treaty Trader Visa
This non-immigrant visa allows foreign nationals of a treaty nation (in which there is a treaty of commerce agreement with the U.S. for commerce/navigation) to enter the U.S. and carry out substantial trade.
  • E-2 Investor Visa
This visa, available only to citizens of certain countries who have a treaty with the U.S., allows an individual to enter and work in the U.S. based on a “substantial” investment he or she will be controlling in the U.S., such as pursuing a business operation in which they have made a significant investment. This must be for an ongoing business (i.e. not investment property or stocks) that is expected to employ American workers. Minimum investment is typically $50,000 or larger.
  • L1-A Visa
This non-immigrant visa is used to enter the U.S. and work for a small amount of time (typically 3 months to 5 years). Typically this visa is for companies to transfer employees like executives, managers, and business owners.
  • EB-5 Immigrant Investor
The EB-5 immigrant investor program creates conditional permanent residency for investors who demonstrate that they have or will make a substantial investment in an American business which has or will create American jobs in areas with high unemployment rates. The conditional aspect of this visa can be petitioned after two years for permanent residency.
